Law 1616 of January 21, 2013 aims to “guarantee the full exercise of the Right to Mental Health to the Colombian population, prioritizing boys, girls and adolescents, through the promotion of health and the prevention of mental disorder. , Comprehensive and Integrated Mental Health Care within the scope of the General Social Security Health System, in accordance with the provisions of article 49 of the Constitution and based on the promotional approach of Quality of life and the strategy and principles of Primary Health Care”.

Furthermore, article 6 of the Law establishes the rights of people in the field of mental health:

  1. Right to receive comprehensive, integrated and humanized care by the human team and specialized mental health services.
  2. Right to receive clear, timely, truthful and complete information of the circumstances related to your state of health, diagnosis, treatment and prognosis, including the purpose, method, probable duration and expected benefits, as well as its risks and consequences, of the events or situations causing your deterioration and of the circumstances related to your social security.
  3. Right to receive the specialized and interdisciplinary care and treatments with the best scientific evidence in accordance with scientific advances in mental health.
  4. Right to interventions are the least restrictive of individual freedoms according to current law.
  5. Right to have a psychotherapeutic processwith the times and sessions necessary to ensure dignified treatment to obtain results in terms of change, well-being and quality of life.
  6. Right to receive psychoeducation at the individual and family level about their mental disorder and ways of self-care.
  7. Right to receive work disabilityunder the terms and conditions established by the treating health professional, guaranteeing the recovery of the person’s health.
  8. Right to exercise your civil rights and in case of disability that your disability to exercise these rights be determined by a judge in accordance with law 1306 of 2009 and other current legislation.
  9. Right to not be discriminated against or stigmatized due to their condition of a person subject to mental health care.
  10. Right to receive or reject spiritual or religious help according to your beliefs.
  11. Right to access and maintain the link with the educational system and employmentand not be excluded because of their mental disorder.
  12. Right to receive the medication you require always for therapeutic or diagnostic purposes.
  13. Right to require that informed consent be taken into account to receive treatment.
  14. Right to not be subjected to clinical trials or experimental treatments without your informed consent.
  15. Right to confidentiality of related information with their care process and respect the privacy of other patients.
  16. Right to Reintegration into his family and community.
